The CES proposal is fatally flawed ? Attempts to treat a symptom rather that focusing on the disease. ? Fails to deal with vital capital investments that will be necessary. ? Relies on extraordinarily hypothetical and uncertain assumptions of load growth, T&D CAPEX to meet reliability, grid evolution and the role of efficiency/demand reduction. ? Fails the basic principles of fairness and equity. Recommended solution 1. Halt and suspend the LD1711 program 2. End the use of a fixed solar tariff and develop a DER tariff that reflects the temporal value and system benefit of the electricity, including the value of carbon reductions. 3. Assess and develop a probabilistic assessment of the future distribution network's load growth, potential demand reduction, potential DER location and capacity, T&D requirements for both reliability AND beneficial electrification, based on the goals of the state Climate Action Plan. 4. Require the IOUs to implement system planning that recognizes a multi directional networked grid which incorporates significant demand reduction and energy efficiency programs along with distributed generation. Ideally create an independent Distribution System Operator to ensure utility system planning, DER iintroduction and demand reduction/efficiency measures are adequate and in context with state goals. 5. Implement a cost recovery methodology for the current liability, described below. Alternative cost recovery The LD1711 situation is reminiscent of the early 80's when PURPA required utilities to take generation from non-utility generators at a guaranteed tariff which resulted in stranded investments. Rate measures were enacted providing revenue to write down those costs. Those rate measures were applied across all customer classes. With a guaranteed income flow from rates, utilities could then bond these accounts and withdraw capital from banks to fund both ongoing operations and new T&D CAPEX. This approach could work in Maine.
